Terms of service
The agreement between Kit Africa Ltd ("Kit", "we") and the business that opens a Kit account ("you", "the Customer") for the use of kit.africa, pos.kit.africa, Kit POS Desktop, Kit AI and the Kit mobile and TV apps (together "the Service").
1. Your account
You must be a business or a person acting for one, and at least 18. The person who opens the account confirms they may bind the business. You are responsible for the users you add, for keeping passwords and till devices safe, and for everything done under your logins. Tell us at once at support@kit.africa if you believe an account has been misused.
2. Plans, trial and payment
- Trial. New businesses get 14 days free with no card. At the end you choose a plan or the account is suspended; your data is kept for 90 days so you can export it or subscribe.
- Plans. Economy UGX 268,000 a month (UGX 2,680,000 a year); Deluxe UGX 538,000 a month (UGX 5,380,000 a year); Plus UGX 1,288,000 a month (UGX 12,880,000 a year); ; Custom plans are agreed with sales. Yearly billing equals ten monthly payments. Each plan has limits on locations and users shown on the pricing page. Add-on modules are UGX 50,000 a month each unless the pricing page says otherwise. Accounting is free in every plan. Prices are in Ugandan shillings; where we show US dollars we use the rate on the pricing page, and we may bill in local currency outside Uganda.
- Payment. Plans are paid in advance by mobile money, bank transfer or card. If a payment is more than 7 days late we may remind you, then restrict the account to read-only until it is settled. We do not delete data for late payment within the 90-day window above.
- Taxes. Prices exclude VAT unless the pricing page says it is included. You are responsible for any withholding tax, which must be shown on a certificate so we can credit it.
- Price changes. We give at least 30 days' notice by email to administrators. Changes take effect at your next renewal.
3. Kit AI
Kit AI is included in every plan with a weekly token allowance set out on the pricing page. Extra usage draws on prepaid business credits, which you buy in advance and which never expire or lose value while your account is open. Kit AI is not sold as a separate plan or monthly add-on. It answers from your own records within your own permissions; its answers are information to help you decide, not professional advice, and you remain responsible for decisions, filings and payments made on them. We may limit unusually heavy automated use to protect the Service.
4. Your data
Your business records belong to you. You give us permission to host, process, back up and display them only to provide the Service, as described in our privacy notice, and you confirm you have the right to put personal data about your customers, staff and suppliers into Kit. You can export your records at any time in CSV or PDF form from inside Kit. We do not use your records to train artificial intelligence models and we do not sell them. We keep backups and act as your processor under the Data Protection and Privacy Act, 2019; a data processing agreement is available on request for Customers that need one.
5. Tax, EFRIS and payments
Where you enable EFRIS, Kit sends the invoice data the Uganda Revenue Authority requires and returns the fiscal document numbers. You are responsible for the accuracy of your tax settings, for your TIN and registration, and for filing. Kit Pay and mobile money payments are completed by MTN, Airtel or the partner bank under their terms; we show you their status honestly and help you reconcile, but we do not hold your customers' money. Receipts, stock and accounting figures are only as right as what is entered: check them, and tell us quickly if a calculation looks wrong.
6. Acceptable use
Do not use Kit to break the law, to evade tax, to store material you have no right to, to attack or overload the Service, to resell access without an agreement, or to copy the software. Do not share one user login between several people; add users instead. We may suspend an account that puts other customers or the Service at risk, and we will tell you why.
7. Availability and support
We aim for the Service to be available 99.9 % of the time each month, excluding planned maintenance announced at least 24 hours ahead and run outside East African business hours. Kit POS Desktop keeps selling offline and syncs when the connection returns. Support is by WhatsApp, phone (+256 200 900 604), email and support cases from inside Kit, Monday to Saturday, business hours (EAT). Where a month falls materially short of the target because of us, we extend your subscription by a fair period on request; this is your remedy for downtime.
8. Ownership
Kit, its software, designs, documentation, videos and trade marks belong to Kit Africa Ltd and its licensors. You get a non-exclusive licence to use them for your business while your subscription is active. Ideas you send us about Kit may be used without obligation; your records remain yours.
9. Liability
We provide Kit with reasonable skill and care. Beyond that, the Service is provided as it is, and we do not promise it will meet every requirement or be error-free. We are not liable for loss of profit, revenue or goodwill, or for indirect loss, and our total liability to you in any twelve months is limited to the fees you paid us in that period. Nothing excludes liability that cannot be excluded under Ugandan law, including for fraud or for death or personal injury caused by negligence. You agree to cover us against claims caused by your breach of these terms or of the law.
10. Ending the agreement
You can cancel at any time from Billing or by writing to support@kit.africa; the subscription runs to the end of the paid period and is not refunded except where the law requires or we have failed to provide the Service. We may end the agreement on 30 days' notice, or at once for serious breach or non-payment after the restriction period in section 2. After the end you have 90 days to export your data; then it is deleted as described in the privacy notice.
11. Changes to these terms
We may update these terms. We will post the new version here with a date and email administrators at least 30 days before material changes take effect. Continuing to use Kit after that date means you accept them; if you do not, you may cancel and receive a refund for the unused period.
12. Law and disputes
These terms are governed by the laws of Uganda. We will try to settle any dispute by talking first; failing that, by mediation in Kampala, and then in the courts of Uganda. Customers outside Uganda keep any consumer rights their local law gives them.
